If you need to cancel or postpone a project after signing a contract, please notify us in writing as soon as possible. Cancellation terms - including any deposit forfeiture - are specified in your individual contract. We will not begin work without a signed contract and will not charge for consultations or estimates.
Payment schedules, amounts, and accepted methods are set out in the written contract for each project. A deposit is typically required before permit applications are filed or materials are ordered. Progress payments may be due at specified milestones. Final payment is due upon substantial completion of the project and before final permit closeout, unless otherwise agreed in writing.
Late payments may be subject to interest charges as specified in your contract. We reserve the right to suspend work on a project if payments are not made according to the agreed schedule.
We obtain all required building permits from the applicable local authority for work performed under our contracts, unless otherwise agreed in writing. You agree to cooperate with reasonable requests needed to complete permitting - for example, providing access to your property for inspections or supplying documentation related to HOA approval.
If an HOA or community association requires separate approval for exterior work, it is your responsibility to confirm that such approval is in place or to work with us to obtain it before construction begins. We are not liable for delays caused by HOA review processes.
To the maximum extent permitted by law, Palm Beach Gardens Lanai Sunrooms & Patios is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or any services we provide, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or our services will not exceed the amount you have paid us for the specific project that gives rise to the claim. Some jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages, so some of these limitations may not apply to you.
The Site and its content are provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Warranty terms for completed construction work are set out in the individual project contract. Any workmanship warranty covers defects in materials and labor under normal use conditions and does not cover damage caused by severe weather events, acts of God, customer modifications, or ordinary wear and tear. Manufacturer warranties on materials and products are passed through to the customer to the extent they are transferable.
All content on the Site - including text, images, graphics, logos, and design - is owned by or licensed to Palm Beach Gardens Lanai Sunrooms & Patios and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.
We prefer to resolve any disputes informally. If you have a concern about our work or these Terms, please contact us first at hi@palmbeachgardenssunrooms.com and give us a reasonable opportunity to address it before initiating any formal proceedings.
If we cannot resolve a dispute informally, both parties agree to attempt mediation before pursuing litigation. Mediation will take place in Palm Beach County, Florida, unless both parties agree to another location in writing.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Palm Beach County, Florida.
We reserve the right to update or modify these Terms at any time. When we do, we will update the effective date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
Changes to these Terms do not affect the terms of any signed project contract already in effect.
